I. Data processing

I process your personal data exclusively within the framework of the valid and applicable data protection regulations.

1. processing of data when accessing and using our website

In principle, you can use my website without disclosing your personal data. When you access my website, data is stored on the servers I use for security purposes, such as the name of your internet service provider, the website from which you are visiting me, the pages you visit on my website and your anonymised IP address. This data may allow you to be identified, but it is not used to identify you personally. They can be analysed for statistical purposes, but the individual user remains anonymous.

2. processing of personal (health) data during consultation, examination or other contact with us; purposes of processing

Personal data are individual details about personal or factual circumstances of an identified or identifiable natural person. It can therefore be used to identify a person. Personal data therefore includes your real name, address and telephone number and, in particular, any health data, e.g. your medication history or other information about your state of health.

Information that is not directly associated with the real identity (such as a user's favourite websites or the number of users of a website) is not included.

If you provide me with personal (health) data about yourself in the context of an examination via the HY STUDIO practices (via a link to the HY STUDIO booking page), e.g. telephone number or e-mail, this will be stored on the server (used by HY STUDIO), the personal data that is collected in the context of making an appointment will be stored on the servers of Claysen GmbH, Scheibenstraße 121, 48153 Münster and processed for the purposes stated below:

a) For contact initiation, subsequent appointment scheduling, cancellations, and modifications, as well as reminders. b) For billing the services you have utilized; c) For internal business purposes, including statistical analysis; d) To optimize the website, enabling us to better understand who uses the website and how, thereby improving our understanding of the needs and interests of our visitors and users. e) For contacting regarding follow-up treatments. The data you provide, such as your name, email address, phone number, and/or other health-related information, are necessary for the examination you request and are therefore collected in advance. It is important to note that this often involves particularly sensitive health data, which may allow conclusions about your health condition.

For data processing for the purpose mentioned in section a), I use the services of the above-mentioned Claysen GmbH in the HY STUDIO practices. I also use the services of IONIQ GmbH, Rosa-Luxemburg-Straße 2, 10178 Berlin, Germany, and Heartbeat Labs, Rosa-Luxemburg-Straße 2, 10178 Berlin, Germany, for data processing for the purposes mentioned in sections b) to d). They only have access to your personal data, not to your personal health data.

If it is possible to enter personal data on my website, I would like to point out that only the specially marked mandatory fields are required to process enquiries and fulfil contracts. All other data is voluntary and will be processed by me to optimise my offer and, if necessary, for the above-mentioned purposes.

Your personal data will not be made available to third parties in any form by me or persons authorised by me, unless this is done in the context of contract processing or you have given your consent or an official order exists.

3. processing and disclosure of personal data

I will only process the personal (health) data you provide to us in the context of treatment in the HY STUDIO practices for the purposes stated under I.2. Your personal data will be passed on to Claysen GmbH for the purpose of booking appointments (if you use the link to the HY STUDIO studio page to book an appointment). Billing takes place via IONIQ GmbH in the HY STUDIO practices. In both cases, only your personal data, without your personal health data, will be passed on for contact and billing purposes.

Various payment methods are available for billing your treatment at HY STUDIO practices.

Your health data will not be passed on to other third parties.

4. consent

If you make use of examination services in the HY STUDIO practices and submit a declaration of consent with regard to this data protection declaration, you agree to the processing of your personal data described in sections I.2. and I.3.

5 Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double opt-in procedure to subscribe to our newsletter. This means that after you have registered, we will send you an e-mail to the e-mail address you have provided in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within [24 hours], your information will be blocked and automatically deleted after one month. We also store the IP addresses you use and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. [The provision of further, separately marked data is voluntary and is used to be able to address you personally]. After your confirmation, we will save your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. a GDPR.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare your cancellation by clicking on the link provided in every newsletter email or by sending an email to hy@hystudio.de or by sending a message to the contact details given in the legal notice.

(5) We would like to point out that we evaluate your user behaviour when sending the newsletter. For this analysis, the emails sent contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the analyses, we link the data mentioned in No. 1 and the web beacons with your email address and an individual ID. Links received in the newsletter also contain this ID. We use the data obtained in this way to create a user profile in order to tailor the newsletter to your individual interests. We record when you read our newsletters, which links you click on in them and deduce your personal interests from this. We link this data to the actions you take on our website.

You can object to this tracking at any time by clicking on the separate link provided in every email or by informing us via another contact channel. The information will be stored for as long as you are subscribed to the newsletter. After you unsubscribe, we store the data purely statistically and anonymously.

We use the SendinBlue software from the manufacturer to send the newsletter:

If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation affects the permissibility of the processing of your personal data after you have given it to us.

If we base the processing of your personal data on the balancing of interests, you can object to the processing. This is the case if, in particular, the processing is not necessary for the fulfilment of a contract with you, which is described by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and will either discontinue or adapt the data processing or show you our compelling reasons worthy of protection on the basis of which we will continue the processing.
